  1. Parties to this agreement

    1. The Service is intended for private individuals, institutions, and companies who live / which are located in the countries listed on the Service website. The Service Provider will not trade with or provide any services to OFAC and sanctioned countries.

    2. Return policy does not apply to orders made by institutions or companies.

    3. You must be 18 or older to order products from the Service.

    4. Everything in the Service, including images, drawings, sound, graphics, and text, is protected by worldwide copyright and other proprietary laws and treaty provisions. Service Provider grants you a limited license to access and make personal use of this site, and not to download, except where specifically invited, nor to duplicate, sell or modify, any portion of this site without express written authorization from the Service Provider.

  2. Registration

    1. Users can register by filling out the registration form and choosing a username and password. To register User must provide his/her real name, address, phone number/ mobile phone number, date of birth, and e-mail address. In addition to the above-mentioned information, the institutional and corporate customers must include the trade registry number and VAT number. By registration User warrants that he/she has read the provisions of this agreement, agrees to these provisions, and pledges oneself to comply with these provisions.

    2. The User ordering on behalf of a company warrants that he/she has sufficient authority to order the items in question and bind that company to this Agreement.

    3. Registration is free of any charge.

  3. User responsibilities

    3. The User is responsible for maintaining the confidentiality of his account.

    4. The user must be 18 or older to order products from the Service.

    5. Customer using the website who are Minor /under the age of 18 shall not register as a User of the website and shall not transact on or use the website.

    6. Everything in the Service, including images, drawings, sound, graphics, and text, is protected by worldwide copyright and other proprietary laws and treaty provisions. Service Provider grants you a limited license to access and make personal use of this site, and not to download, except where specifically invited, nor to duplicate, sell or modify, any portion of this site without express written authorization from the Service Provider.

  4. Privacy policy

    1. The Service Provider is committed to respecting the User´s privacy. The Service Provider is the sole owner of the information collected on https://thebowerycompany.com Website ("Site"). The information is used entirely and only by us, except in cases where we use third-party agents to perform certain functions for us, such as credit card processing, delivering packages, and fulfilling orders. In those cases, we provide only the information necessary for the performance of those specific functions. If you make a payment for our products or services on our website, the details you are asked to submit will be provided directly to our payment provider via a secured connection.

    2. The Service Provider does not transfer any information given by the User to a third party for any other purpose than processing the order. We will not sell, share or rent this information to any other entity for any reason.

    3. Service Provider reserves the right to transfer the information provided by the User to the authorities in the case of infringement of laws and violation of good practice by the User.

    4. The user has the right to examine, change and delete information about him/herself from the register. Upon request, we provide any site visitor who establishes his or her identity to our satisfaction with access to information that we have collected from them.

  5. Ordering and Payment Terms

    1. When an order is placed in the Service the binding sales agreement between the User and the Service Provider is reached when the User receives an order confirmation e-mail in which the availability and estimated delivery time are confirmed.

    2. In some cases, such as a pre-order of a customized product, payment must be received by the Service Provider prior to acceptance of an order. The Service Provider reserves the right to refuse to process an order without an initial payment.

    3. The user (cardholder) must retain a copy of transaction records and Merchant policies and rules.

    4. The user has the right to examine, change and delete information about him/herself from the register. Upon request, we provide any site visitor who establishes his or her identity to our satisfaction with access to information that we have collected from them.

    5. Service Provider reserves the right to reject any order at its sole discretion.

  6. Product prices

    1. The product price is the price displayed for the item on the Service at the time of ordering.

    2. Delivery charges vary depending on the shipping destination and are stated for each order at check-out.

    3. All the product prices and delivery charges are displayed in AED, or in SAR, BHD, KWD, OMR, JOD, LBP, and USD when the User changes the shipping destination. We accept payments online using Visa and MasterCard credit/debit cards in AED and payments will be processed in AED. The cardholder must retain a copy of transaction records and Merchant policies and rules.

    4. For the European Union countries all prices displayed are inclusive of VAT (Value Added Tax) and are shipped to on a DDP (Delivered Duty paid). All non-EU countries are shipped to on a DDU (Delivered Duty Unpaid) basis and all the product prices displayed are exclusive of all taxes and duties. For domestic deliveries in the UAE, prices are inclusive of VAT (Value Added Tax).

  7. Delivery and storage

    1. Delivery charges vary depending on the shipping destination and are stated for each order at check-out.

    2. Delivery times vary from product to product. Delivery time is determined by the availability of the product and order destination.

    3. Purchased items that are in stock will be dispatched within 72 hours from the order date. Items can be warehoused up to a maximum of 7 days, after this a warehousing fee of 5% of the total order value applies.

    4. Service Provider shall not be liable for delays in performing or failure to perform this Agreement or any obligations hereunder, which are directly attributable to causes beyond its reasonable control (force majeure), including, but not limited to, acts of God, fires, strikes, labor disputes, war, acts or intervention by any governmental authority, failure of a common carrier, supplier, hardware, software, browser, or communications equipment, or network failure, congestion, or malfunction.

    5. Service Provider reserves the right to deliver different products ordered in the same time separately.

    6. The Service Provider takes responsibility for the loss and damage of the product that occurred during the delivery if he or the driver is alerted immediately by the User during the delivery process of a damage. The User may refuse delivery in this case. Due to shipping and delivery company policies, all damage claims WILL BE DENIED if the User does not inform the Service Provider / the driver immediately that the product (s) purchased is (are) damaged at the time of delivery. The User should notify the Service Provider of refusal so that the Service Provider can anticipate the return and send out a new item. IMPORTANT: Before signing, the User must inform the driver / the Service Provider of any damage for any Damage Claim to be accepted. A failure to do so WILL NOT allow the User to file a claim later if he finds damage when the box/es is (are) opened. The Service Provider reserves the right to repair or replace the damaged item at its sole discretion.

  8. Purchasing a Displayed Item

  9. If you are purchasing an item part of the displayed stock in our showroom, please note that our sales team will ask you to sign an acceptance note that you have well examined the displayed piece and you are happy with its condition. If the item has been purchased online or through WhatsApp, our sales team will send you a video of the item, upon your confirmation it will be packed and delivered to you. We are unable to accept a return/refund/exchange or claim, for a displayed after you have confirmed your acceptance of its condition and received the necessary information about it.

  10. Cancellation and returns

    1. Users can cancel his / her order within 24 hours of placing it. However no refund shall be made, instead, the Service Provider will issue a store credit equal to the amount of the User's order.

    2. The user has a 7-day right to return or exchange a product and a 3-day right to return or exchange a sale item. The return policy does not extend to the following products:

      1. Pre-orders

      2. Art prints

      3. Books

      4. Candles

      5. Soft Furnishings: rugs, mats, bedspreads, throws and cushions, sofas and armchairs

      6. Products that need assembly: Sofas, armchairs, divans, and other upholstered furniture

    3. The customer has a right to return a product if:

      1. The order has been canceled according to the terms and conditions by notifying The Bowery Company within 3 days of delivery if the product is a sale item, 7 days of delivery for fully priced items and 14 days in case the item was a gift received upon submission of a gift receipt.

      2. The product has not been used

      3. The product is in the condition that the customer received it in and all the parts of the product are included in the branded package

      4. The product has been repackaged into its original branded package

    4. The product must be returned immediately after cancellation.

    5. When returning products, the User will be responsible for the risk of damages.

    6. The standard return fee is AED 25 but it could be higher and depends on the volumetric weight of your returned item (s). Please note that the return fee for large furniture pieces is AED 150 even if exchanged, the fees remain the same. We reserve the right to ask you for a picture of the returned package before we request a collection from our shipping partner.

    7. The Service provider does NOT offer refunds.

      • Pre-Orders:

      • No returns, exchange or refund on pre-orders once placed online or in-store .

      • Goods will not be handed over until full payment is received.

      • Goods will be delivered as soon as they are available.

      • Lead time for standard items varies from product to product, but an estimated lead time will be stated once your order is placed. Delivery on special products as well as large orders is agreed on a case by case basis.

      • Any estimated delivery date notified or communicated by The Bowery General Trading LLC is solely based on The Bowery General Trading LLC ‘s best knowledge and delivery dates are therefore not binding on The Bowery General Trading LLC.

      • If we learn that it is not possible to deliver the goods within the agreed estimated delivery date; you will be informed of the delay as soon as possible and informed of a new expected shipment arrival. If the delay exceeds 3 months from the initial confirmed date of arrival and is not due to force majeure, you are entitled to cancel the order. The customer is not entitled to make further claims to The Bowery General Trading LLC in cases of delays.

      • The Bowery General Trading LLC cannot be held accountable for delivery problems in cases of force majeure. In these situations, delivery schedules will be prolonged.

      • The Bowery General Trading LLC shall not be liable if the following non-exhaustive circumstances of force majeure occur at The Bowery General Trading LLC or its suppliers: scarcity of goods, defects or delay in delivery from suppliers, lack of means of transportation, exchange control regulations, import and export restrictions, computer viruses or any other circumstances that are beyond the parties direct control. In such case, the Party shall be entitled to postpone fulfillment of the obligation until the obstacle has ceased or, alternatively, to cancel the agreement, fully or partly without incurring any liability for this, if the obstacle causes fulfillment to be postponed for more than six (6) months.

  11. Force Majeure Clause

  12. In the event of unforeseen major events (hereinafter referred to as "Force Majeure"), including but not limited to wars, environmental disasters, natural calamities, government actions, or any similar unforeseen major events beyond the control of The Bowery Company, The Bowery Company shall not be held liable for any delays or disruptions caused by the Force Majeure.

      11.1. Specific Reference to War Situation and Sea Freight Delays:

    1. Current War Situation: The Bowery Company acknowledges that the ongoing war situation in the region may impact the timely delivery of goods. Delays in sea freight may occur due to rerouting of ships and disruptions at the origin.

    2. Sea Freight Delays: The Bowery Company shall not be held responsible for delays in sea freight caused by the rerouting of ships and other war-related disruptions. This includes delays in the departure of ships from the origin.

    3. 11.2. Effects of Force Majeure:

    4. Delays: The Bowery Company shall not be held responsible for any delays in the performance of our obligations under the agreement that are directly or indirectly caused by the Force Majeure.

    5. Liability: The Bowery Company shall not be liable to compensate, refund, or offer additional discounts for any delays or disruptions caused by the Force Majeure, including those related to the current war situation impacting sea freight.

    6. 11.3. Customer Understanding:

      By engaging in a business relationship with The Bowery Company, the customer acknowledges and agrees that unforeseen major events, including the current war situation, may impact the regular course of business. The Bowery Company shall be excused from any non-performance or delay in performance arising out of such events

  13. Changes to the Service and this Agreement

  14. Service Provider reserves the right to make changes to the Service, policies, and this User Agreement at any time.

  15. Jurisdiction and Settlement of Disputes

  16. The United Arab Emirates is our country of domicile and this User Agreement will be interpreted, construed and enforced in all respects in accordance with the laws of the United Arab Emirates. Any dispute or claim arising out of or in connection with this website shall be governed and construed in accordance with the laws of the UAE.

  17. Electrical products

  18. The Bowery Company General Trading LLC does not provide extended warranties for electrical items; the customer is to rely on the supplier's warranty.

  19. Language of this Agreement

  20. The parties have agreed that this Agreement and related documents shall be written in English.
